Terms and Conditions of Use
Acceptance of the General Terms and Conditions of Sale
We hereby inform you that the following general terms and conditions of sale, in compliance with the regulations in force for consumer protection, set out the terms and procedures for purchasing products safely, easily and conveniently online through www.matsurinerd.com.
By placing an order through any of the available methods, the Customer declares that they have read all the information provided during the purchasing process and fully accept the general terms and payment conditions set out below.
By placing an order on this website, the Customer declares that they are of legal age, have read the terms and conditions of sale and the available payment methods, and are aware of the entire purchasing procedure.
The company shall not be held contractually or extra-contractually liable for any direct or indirect damage to persons and/or property caused by the failure to accept, even partially, an order.
The company reserves the right to modify these general terms and conditions of sale at any time by publishing the updated version on the website.
Purchasing Methods
For each product, the website provides a description containing its main characteristics. All information provided to assist with the purchase should be understood as general informational material only.
Please note that the image accompanying the product description may not be a completely accurate representation of its characteristics and may differ in terms of colour, dimensions or accessories shown in the image.
Matsuri Nerd will confirm the correct receipt of an order by means of an automatic email sent to the email address provided by the Customer during registration. This confirmation message will contain an “order number” to be used when requesting information.
The message will contain all the information entered by the Customer, who undertakes to verify its accuracy and promptly communicate any corrections to negozio@matsurinerd.com.
Product Availability
Product availability refers to the availability shown at the time the Customer views the product page. However, this should be considered purely indicative because, due to multiple users accessing the website at the same time, products may be sold to other customers before the order is confirmed.
Even after the order confirmation email has been sent, products may become partially or completely unavailable. In such cases, the Customer will be promptly informed and may decide whether to accept delivery of only the available products, wait for the requested goods to arrive in stock where possible, or request cancellation of the order by contacting Customer Service via email.
Pre-Order Products and Pre-Order Cancellations
For more information, please visit the Pre-Orders and Cancellations page.
Payment Methods
Prices may change without prior notice, and the only valid price is the one displayed at the time the order is confirmed.
Goods will only be shipped once payment has been received. In the event of an order cancellation after payment has been made, Matsuri Nerd undertakes to refund the amount paid by the Customer, by agreement with the Customer, within 5 business days of the cancellation.
In the case of purchases made using the “PayPal” payment method, PayPal will immediately charge the amount relating to the purchase upon completion of the online transaction. You do NOT need to be a PayPal user to use this payment method.
In the case of payment by bank transfer, the Customer will receive an email from Matsuri Nerd containing the payment details, sent from negozio@matsurinerd.com. Once the payment has been made, the Customer must notify us at negozio@matsurinerd.com, so that we can verify the payment and ship the goods.
Any other payment method added and activated on the Matsuri Nerd store will fall under one of the two methods described above, depending on how the payment is managed by the payment service provider.
Shipping and Delivery
Matsuri Nerd shall in no event be held responsible for damage caused during transportation once the goods have been entrusted to the courier.
Upon delivery of the goods by the courier, the Customer is required to check the number of packages and the condition of the packaging and, subsequently, of the products.
In the event of visible damage or tampering with the package, the Customer must accept the package “With Reservation” and have the courier record this as a note upon delivery. This will make it possible to request reimbursement for the shipment.
If an untracked shipping service is selected, Matsuri Nerd shall in no event be held responsible for any loss or service failure by the selected courier, as the choice of a cheaper, untracked shipping service rather than a tracked service is the responsibility and decision of the purchaser.
Liability
Matsuri Nerd shall not be held responsible for service disruptions attributable to force majeure or unforeseen circumstances, including those resulting from malfunctions or disruptions of the internet network, where it is unable to fulfil an order within the timeframes established by the contract.
The availability of each item is provided for information purposes only, is not contractually binding, and the seller shall not be held liable in the event that one or more products become unavailable.
User Responsibility for Uploaded Content
The selection of the content and images to be printed, as well as obtaining any necessary authorisations for their reproduction, remains the sole responsibility of the user.
Matsuri Nerd will not verify the content in any way, except with regard to technical specifications and graphic compatibility with the required specifications, and shall in no way be held responsible for the unauthorised use of images by users or for any violation of third-party rights relating to such images.
The user therefore releases Matsuri Nerd from any liability towards third parties who may claim violations of intellectual property rights, damage to reputation, honour, dignity or moral integrity, or any other financial or non-financial damage resulting from the printing of images and content uploaded by the user. The user also undertakes to indemnify and hold Matsuri Nerd harmless against any such claims.
Matsuri Nerd reserves the right to block any order involving an obvious violation of third-party intellectual property rights or containing content that is defamatory, violent or otherwise contrary to public order and accepted standards of decency.
Files uploaded to the Matsuri Nerd platform will be stored for the entire duration of the processing in order to allow the work to be completed. They will subsequently be retained for 30 days from the date the goods are shipped, solely for the purpose of verifying any complaints that may arise. Once this period has expired, the files will be deleted and cannot be recovered.
Under no circumstances may Matsuri Nerd use such material for subsequent purposes without the authorisation of the respective owners. Ownership and responsibility for the content uploaded and managed through Matsuri Nerd therefore remain with the Customer.
